(MVR) conveyed Architectural Control to Leisure\nValley Homeowners, INC. (LVR) Property Owners Association (POA). During October\n2019, the LVR Board had communicated to the owners that the architectural controls\napproved and conveyed by MVR to LVR would be accepted \u201cas-is\u201d or \u201cgrandfathered\nin\u201d with the stipulation that these MVR approved architectural controls would\nnot establish any past precedence for LVR\u2019s Architectural Control Committee\n(ACC). An excerpt of the communication is inserted below:<\/p>\n\n\n\n<p><strong><em>\u201cLVR Architectural Control\nCommittee will use existing Covenants, Conditions &amp; Restrictions (CCR\u2019s) as\ntheir guidance when considering any request for new construction or\nmodification of existing structures. There will be no past precedents from any\nactions taken previously by Martin Valley Ranch.<\/em><\/strong><\/p>\n\n\n\n<p><strong><em>Any construction prior to LVR\nassuming Architectural control will be accepted as approved by Martin Valley\nRanch.&nbsp;&nbsp; Owners that have had\nconstruction on their lots previous to LVR assuming control are expected to be\nable to produce documents that show the construction was reviewed and approved\nby Martin Valley Ranch \u2013 individual lot owners are responsible for any\ninfringement on easements or violations of any county or higher level\ngovernment agencies\u201d<\/em><\/strong><\/p>\n\n\n\n<p>During this 2019\/2020 winter season, the LVR Board has\nallowed owners who were non-compliant a grace period to remedy their\nnon-compliance with the LVR covenants. As the 2019\/2020 season ends, the \u201cgrace\nperiod\u201d is over; and owners must be in-compliance with the LVR governing\ndocuments. As Board President, I have communicated to you, the members, at our Membership\nMeetings that any owner who is out of compliance with any aspects of the\ngoverning documents needs to become compliant as soon as possible.<\/p>\n\n\n\n<p>Therefore, this letter is to inform the LVR membership that\nthe LVR POA will comply and enforce all of the LVR Governing Documents and <strong>all\n<\/strong>Texas State Property Codes including <strong>Title 11. Restrictive\nCovenants<\/strong> one hundred percent (100%). <\/p>\n\n\n\n<p>The LVR POA is in the process of adopting Policies which\nwill be filed with Hidalgo County for the following sections of the Title 11\nProperty Codes:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><em>Sec. 202.007 Rain Barrel\/ Rain Harvesting\nSystem<\/em><\/li><li><em>Sec. 202.010 Regulation of Solar Energy\nDevices<\/em><\/li><li><em>Sec. 202.011 Regulation of Certain Roofing\nMaterial<\/em><\/li><li><em>Sec. 202.012 Flag Display and Flagpoles<\/em><\/li><li><em>Sec. 202.018 Regulation of the Display of\nCertain Religious Items<\/em><\/li><\/ul>\n\n\n\n<p>Once adopted, these Policies will be sent out to the\nmembership for review and posted on the LVR website.<\/p>\n\n\n\n<p>In addition, LVR will comply and enforce Texas State\nElection Codes including <strong>Title 15. Chapter 259. Political Signs. Sec.\n259.002. Regulation of Display of Political Signs by Property Owner\u2019s\nAssociation<\/strong>. In accordance with Title 15 Election Codes, property\nowners may display political signs advertising a candidate or measure for an\nelection: (<strong>Title 15 Election Code quoted in\nitalics and underlined below.<\/strong>)<\/p>\n\n\n\n<p><em>(b), (1) on or after the <strong>90<sup>th<\/sup>\nday<\/strong> before the date of the election to which the sign relates; or (2) before\nthe <strong>10<sup>th<\/sup> day<\/strong> after that election date.<\/em><\/p>\n\n\n\n<p>If the property owner displays political signs before the\nstart of the 90<sup>th<\/sup> day period or after the 10<sup>th<\/sup> day period\nof an election: <\/p>\n\n\n\n<p><em>(e) the property owner\u2019s\nassociation may remove a sign displayed in violation of a restrictive covenant\npermitted by this section. <\/em><\/p>\n\n\n\n<p><strong><em>The LVR Board of Directors and its\u2019 designated\ncommittees will enforce compliance for all restrictive covenants as stated in Title\n15 Election Code as they pertain to a property owner\u2019s association and Title 11\nProperty Codes Restrictive Covenants. <\/em><\/strong><em>(Refer to statues.capital.texas.gov\nwebsite)<\/em><\/p>\n\n\n\n<p>LVR POA is in the process of adopting a new policy regarding\n<strong>Title 15. Chapter 259. Political Signs. Sec. 259.002. Regulation of\nDisplay of Political Signs by Property Owner\u2019s Association<\/strong>.
